End User Licence Agreement

1. Your licence

We give you a personal, non-exclusive and non-transferable licence to download and use the Hunting Game app on devices you own or control, for your own non-commercial fun. We can only end it as section 12 says.

On Apple devices, this licence is limited to Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, except that other accounts linked to you through Family Sharing or volume purchasing may also use the app.

2. What you may not do

You may not sell, rent, sub-license, lend or distribute the app; remove or change any notice in it; use it to build a competing product; or use it in a way that breaks the law or the Community Guidelines.

You may not copy, modify, translate, reverse engineer, decompile or disassemble the app, or try to get its source code, except where the law gives you that right anyway. In the EU that includes making a back-up copy, studying how the software works, and decompiling for interoperability. If you need interoperability information, ask us first; we would rather just tell you.

3. Who owns what

We and our licensors own the app: the software, design, artwork, name and branding. This licence lets you use it; it does not give you ownership. Anything not expressly granted is reserved.

Your display name, profile photo and messages stay yours, under section 7 of the Terms of Service.

4. Updates

We release updates, including updates that download and install automatically. These are signed, so your phone only installs updates that come from us. Some updates are needed to keep the app secure or working, and after a reasonable time older versions may stop working and ask you to update from the store. If you have Pro, we supply the updates needed to keep it working as described for as long as you are subscribed.

5. Maintenance and support

We alone are responsible for maintaining and supporting the app. Apple and Google have no obligation at all to provide maintenance or support for it. Contact us at contact@hunting-game.com.

6. Warranty

We alone are responsible for any warranty for the app, whether express or implied by law, to the extent it has not been effectively disclaimed.

If the app does not conform to an applicable warranty and you got it from the App Store, you may tell Apple, and Apple will refund the price of the app to you. The app is free to download, so this is usually nothing. To the maximum extent allowed by law, Apple has no other warranty obligation for the app.

Your legal guarantee of conformity as a consumer, and the remedies in section 8 of the Terms of Service, are owed by us and are not affected.

7. Claims about the app

We, not Apple or Google, are responsible for dealing with any claim by you or anyone else about the app or your possession and use of it. That includes product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

8. Intellectual property claims

If anyone claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple or Google, are solely responsible for investigating, defending, settling and discharging that claim.

9. Legal compliance

You confirm that you are not in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. You will follow any applicable export control laws.

10. Third-party terms

You must follow the terms of third-party services you use with the app, such as the Apple Media Services Terms and Conditions, the Google Play Terms of Service, and your mobile provider's terms. The companies whose services the app uses are listed in our subprocessor list. The app includes open-source software under its own licences.

11. Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this agreement. When you accept it, Apple has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

12. Ending this licence

This licence lasts as long as you use the app. It ends when you delete your account or the app, when we stop providing Hunting Game with the notice in section 11 of the Terms of Service, or when we end it because you seriously or repeatedly broke this agreement or the Terms of Service. In that last case we tell you why and, unless that would be unreasonable, give you a chance to put it right first.

When it ends, stop using the app and remove it from your devices. Sections 3, 6, 7, 8 and 13 keep applying.

13. Responsibility for damage

Nothing in this agreement limits our liability for death or personal injury caused by our fault or that of people acting for us, for fraud, for intentional or gross fault, or for anything else the law does not let us limit. Section 13 of the Terms of Service explains responsibility for damage, and it applies here too.

Please read section 5 of the Terms of Service before you play. The app cannot see traffic, water or obstacles, and it is not a navigation, safety or emergency service.

14. Law and disputes

Belgian law applies. If you are a consumer, you keep the protection of the mandatory rules of the country where you live. Section 15 of the Terms of Service says which courts can decide a dispute, and it applies here too. The out-of-court route in that section is open to you.
